1. About these terms

These Terms of Service govern your use of the Beacon Digital website (beacondigital.co.za) and all services provided by Beacon Digital, including website design, development, hosting, and digital marketing campaign management. By using our services, you agree to these terms.

Beacon Digital is operated by Liam Keenan, trading as Beacon Digital, with a registered address at 3 Siffie Crescent, Vermont, Hermanus, Western Cape, 7201, South Africa.

2. Services

Beacon Digital provides the following services:

• Custom website design and development for South African businesses
• Managed website hosting on global edge infrastructure
• SSL certificates, domain management, and ongoing maintenance
• Google Search Ads campaign setup, management, and reporting
• Content management system (CMS) access for client-managed updates

All websites are built as custom React/Next.js applications. You receive a preview of your completed website before any payment is required. Payment is only due upon your approval of the preview.

3. Pricing and payment

Beacon Digital charges a single monthly subscription fee with no setup cost. Your subscription begins only upon your approval of the site preview. All prices are quoted in South African Rand (ZAR) and include VAT where applicable.

Payments are processed securely via PayFast. Beacon Digital does not store card details. Monthly fees are billed in advance on the anniversary of your go-live date. Failure to pay within 14 days of the due date may result in temporary suspension of your site.

4. Cancellation and refunds

There is no setup fee. A minimum term of 6 months applies; after that you may cancel at any time by contacting us, effective at the end of the current billing period. There are no cancellation penalties.

If you are not satisfied with your site preview, you are under no obligation to proceed or pay. We will not charge you for a site you have not approved.

5. Intellectual property

Upon subscribing and going live, you own the content and design of your website. Beacon Digital retains the right to display your project in our portfolio unless you request otherwise in writing.

Content you provide — photos, logos, text, and business information — remains your property. You confirm that you have the rights to use any content you supply to us.

6. Google Ads management

Where Beacon Digital manages Google Ads campaigns on your behalf, we act as your authorised representative. All ad spend is billed directly to your Google Ads account — we do not mark up ad spend. Management fees are charged separately and quoted in advance.

You retain full ownership of your Google Ads account at all times. Either party may terminate the Google Ads management arrangement with 30 days written notice.

7. Limitation of liability

Beacon Digital is not liable for any indirect, incidental, or consequential damages arising from use of our services, including loss of revenue, loss of data, or business interruption. Our total liability in any matter is limited to the fees paid by you in the three months preceding the claim.

We make every effort to keep your site online and performant, but we do not guarantee 100% uptime. Hosting is provided on a best-efforts basis on third-party infrastructure (Vercel).

8. Governing law

These terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in the courts of the Western Cape, South Africa.
